Booking Terms and Conditions

These booking conditions apply to any accommodation booking that you make with us and form the basis of your contract with us, so please read them carefully.

Making a Booking

Once we have discussed your requirements, we will send you an itinerary detailing the transportation, accommodation, meals and other services which will be provided as part of your vacation. You will also receive written confirmation of the price. You should check that the arrangements meet with your approval and contact us as soon as possible if you need to make any changes. Once the itinerary and price has been agreed in principal you can book the vacation by completing and signing our booking form and returning it to us with a deposit of 20% of the total price, or other such sum as we may notify you at the time of booking. Deposit payments may be made by credit card without surcharge, whist balance payments are taken either by credit card with a 2.5% surcharge or by bank transfer into our account. For departures within 12 weeks of the booking date, payments will be taken in full by credit card with a 2.5% surcharge. If for any reason we do not accept your booking, your deposit will be returned. Your contract with Opulent Africa Limited will come into existence on the date on which we take your deposit.

In full compliance with The Package Travel, Package Holidays and Package Tours Regulations 1992, all payments made to Opulent Africa are protected by our Air Travel Organiser’s Licence (ATOL) and through our membership to the Association of Bonded Travel Organisers (ABTOT).

When you make a booking you are confirming that you understand and have accepted, on behalf of yourself and all members of your party, our booking terms and conditions. All contracts with Opulent Africa Limited are made in England subject to these terms and conditions and are subject to English Law and the exclusive jurisdiction of the English Courts.

It is important for you to check the details on the confirmation invoice when you receive it. In the event of any discrepancy, please contact us immediately. If you arrange your vacation directly with us, all correspondence and other communications will be send to the address specified by you on the booking form, which will be that of the lead name unless otherwise stated by you. If your booking is with a travel agent, all communications will be with that agent – who acts as agent for you in regard to all communications from us to you.

Many airlines now require the full name of all passengers travelling. We will therefore ask you at the time of booking to provide us with your first forename as well as your title and surname as shown in your passport.

Payment Terms

A deposit of 20% of the total vacation cost is required at the time of booking and the balance of payment must be made at least 90 days before departure. Bookings made within 90 days of departure must be paid in full when booking. If payment is not received by the due date, we have the right to cancel the booking, retain all deposits made and levy cancellation charges. Once your booking has been confirmed, any changes that you wish to make will be subject to an amendment charge of $50 per person. We do not guarantee that it will be possible to make such changes. In particular, airlines regard name or other changes as a cancellation and rebooking, and these may incur a 100% cancellation charge.

Pricing Policy

We reserve the right to change our prices at any time prior to the conclusion of a contract between us. Following this we will guarantee that no price changes will be made other than as a result of events beyond our control.

Events beyond our control may include currency fluctuations, government action, changes to accommodation and transportation costs (including the cost of fuel), airline fares, fees (including park fees) and local taxes (e.g. airport departure taxes and VAT increases). Airfares booked directly by you are subject to the terms and conditions imposed by the airline and are not our responsibility. Price increases of less than 2% (excluding insurance premiums and any amendment charges) will be absorbed and we will only pass on any increase above that level.

Travel Insurance

It is a condition of your booking with us that you have adequate travel insurance in place for each member of your party, covering both cancellation charges and medical emergency and repatriation costs, subject to the conditions imposed by such a policy (please note that, although some credit cards may notionally include free travel insurance, this may not extend to cancellation or curtailment). In accepting these booking terms and conditions you will be assumed to have put appropriate insurance in place, and are required to supply details of same.

Cancellation

Should you need to cancel your booking for any reason then you must inform us as soon as possible. Cancellation will take effect from the day we are notified provided that written confirmation is received by us within 24 hours of the original notification. If you cancel your booking more than 12 weeks from departure, you will forfeit your deposit in full. Cancellations received within the final 12 weeks before departure will incur whichever is the greater of: (i) any cancellation costs charged to or incurred by us from third parties (i.e. airlines, hotels, safari companies, etc), or (ii) 50% of the total price due; if cancelled less than 60 days before departure, 100% of the total price due.

You must take out adequate travel insurance which should, in most cases include cover under certain circumstances against loss of deposit or cancellation fees.

Transfer of Bookings

If you are prevented from proceeding with the vacation, you may transfer the booking to a person who satisfies all of the conditions applicable to the booking and provided that you give reasonable notice of your intention to transfer before the date when departure is due to take place. It will not be possible to transfer a booking within 21 days of departure date. Where a transfer is made in accordance with the terms above, both the transferor and the transferee shall be jointly and severally liable to us for payment in full and for any additional costs arising from the transfer.
