Booking Terms and Conditions

Opulent Africa is a trading name of Opulent Africa Limited registed in Texas.

Booking Conditions
These booking conditions apply to any accommodation booking that you make with us and form the basis of your contract with us, so please read them carefully.

Making a Booking
Once we have discussed your requirements, we will send you an itinerary detailing the transportation, accommodation, meals and other services which will be provided as part of your vacation. Once the itinerary and price has been agreed in principal, you can book the vacation by completing, signing and returning our booking form and/or by providing us with a 20% of the total price non-refundable deposit, or other such sumas we may notify you at the time of booking.

Your contract with Opulent Africa Limited will come into existence on the date on which we take your deposit. If for any reason we do not accept your booking, your deposit will be returned.When you make a booking you are confirming that you understand and have accepted, on behalf of yourself and all members of your party, our booking terms and conditions. All contracts with Opulent Africa Limited will be governed and interpreted pursuant to the laws of the State of Texas, notwithstanding any conflicts of law. Any dispute between the parties arising out of or relating to the contract or these Terms and Conditions will be in the state of Texas and federal courts in Austin, Texas.

If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity or enforceability of any remaining provisions. These Terms and Conditions constitute the entire agreement relating to this subject matter. We may revise these Terms and Conditions at any time.

Client’s Responsibility
All travel documents issued to you by us as well as your visas, vaccinations, international air bookings and antimalarial treatments are the client’s own responsibility. The client must also check that they hold a valid 10 year passport prior to departure with at least 6 month’s validity still remaining at their return date. We will not be liable to make any refund or pay compensation if you or any member of your party is unable to proceed with the vacation as planned because of incorrect or missing personal documents. Please ensure you have obtained the correct visas prior to travel.

It is important for you to check the details on the confirmation invoice when you receive it. In the event of any discrepancy, please contact us immediately. If you arrange your vacation directly with us, all correspondence and other communications will be sent to the address specified by you on the booking form, which will be that of the lead name unless otherwise stated by you. If your booking is with a travel agent, all communications will be with that agent – who acts as agent for you in regard to all communications from us to you. Many airlines now require the full names of all passengers travelling. We will therefore ask you at the time of booking to provide us with your first forename as well as your title and surname as shown in your passport. All means of transport, lodging and excursions are suggested to you based on the destination knowledge held by Opulent Africa Limited, discussions held between the two parties and your express written requirements. Opulent Africa Limited are not responsible for subjective disagreement of the suitability of the itinerary. Clients are responsible to understand fully what they are booking and any amendments prior to travel may incur adjustment charges or charges for additional services.

Payment Terms
A deposit of 20% of the total vacation cost is required at the time of booking and the balance of payment must be made at least 90 days before departure. Bookings made within 90 days of departure must be paid in full when booking. If payment is not received by the due date, we have the right to cancel the booking, retain all deposits made and levy cancellation charges. Once your booking has been confirmed, any changes that you wish to make will be subject to an amendment charge of $50 per person. We do not guarantee that it will be possible to make such changes. In particular, airlines regard name or other changes as a cancellation and rebooking, and these may incur a 100% cancellation charge. Pricing Policy

We reserve the right to change our prices at any time prior to the conclusion of a contract between us. Following this we will guarantee that no price changes will be made other than as a result of events beyond our control.

Events beyond our control may include currency fluctuations, government action, changes to accommodation and transportation costs (including the cost of fuel), airline fares, fees (including park fees) and local taxes (e.g. airport departure taxes and VAT increases). Airfares booked directly by you are subject to the terms and conditions imposed by the airline and are not our responsibility. Price increases of less than 2% (excluding insurance premiums and any amendment charges) will be absorbed and we will only pass on any increase above that level.

Travel Insurance
It is a condition of your booking with us that you have adequate travel insurance in place for each member of your party, covering both cancellation charges and medical emergency and repatriation costs, subject to the conditions imposed by such a policy (please note that, although some credit cards may notionally include free travel insurance, this may not extend to cancellation or curtailment). In accepting these booking terms and conditions you will be assumed to have put appropriate insurance in place, and are required to supply details of same.

Should you need to cancel your booking for any reason then you must inform us as soon as possible. Cancellation will take effect from the day we are notified provided that written confirmation is received by us within 24 hours of the original notification. If you cancel your booking more than 12 weeks from departure, you will forfeit your deposit in full. Cancellations received within the final 12 weeks before departure will incur whichever is the greater of: (i) any cancellation costs charged to or incurred by us from third parties (i.e. airlines, hotels, safari companies, etc), or (ii) 50% of the total price due; if cancelled less than 60 days before departure, 100% of the total price due. You must take out adequate travel insurance which should, in most cases include cover under certain circumstances against loss of deposit or cancellation fees.

Transfer of Bookings
If you are prevented from proceeding with the vacation, you may transfer the booking to a person who satisfies all of the conditions applicable to the booking and provided that you give reasonable notice of your intention to transfer before the date when departure is due to take place. It will not be possible to transfer a booking within 21 days of departure date. Where a transfer is made in accordance with the terms above, both the transferor and the transferee shall be jointly and severally liable to us for payment in full and for any additional costs arising from the transfer.

Changes to your Booking
In the unlikely event that we need to make changes to your vacation as booked, which we reserve the right to do at any time, we will inform you immediately. You will be offered alternative accommodation that is of a similar or better standard. You will then have the choice of either accepting these changed arrangements or of accepting a full refund or all monies paid to date. In no circumstances can we be held liable for any consequential loss or incidental expenditure incurred as a result of these changes. We reserve the right to cancel your booking with a full refund of all monies paid at any time.

Our Liability Every effort has been made to ensure the accuracy of the information given in print or displayed on our website. However, there may be occasions where the details or descriptions change or when a typographical error or omissions occur. Opulent Africa Limited are not liable for any error or omission in description or image on this website. If you are in any doubt as to the accuracy of any information given then please check with us. Our liability is limited to the provision of the travel product as booked, acting as agents for the supplier and we have no liability to you for any death, personal injury, loss or damage of any kind. You must ensure that you have adequate insurance cover against such occurrences (see above). All vacations are subject to availability and we will use our best endeavours to ensure that you receive the services that make up the vacation that you chose, and which we confirm. We have taken all reasonable care to make sure that the service providers with whom we work are efficient and reputable, and follow the local and national laws and regulations of the countries where they are provided. Opulent Africa Limited acts as tour operator and agent. The suppliers providing transportation, conveyance or accommodation are independent contractors and are not agents or employees of Opulent Africa Limited. All tickets, coupons and receipts issued by Opulent Africa Limited and all arrangements for transport or conveyance or for accommodation are made by Opulent Africa Limited as agent of the suppliers. By utilizing the services of the suppliers, you agree that neither Opulent Africa Limited nor any subsidiary of affiliate of Opulent Africa Limited shall be liable for any injury, damage, loss accident or delay incurred by you or those traveling with you in connection with any accommodations, transportation or other services resulting directly from any acts or default of the suppliers or from any occurrence or conditions beyond the control of Opulent Africa Limited including defects in vehicles or breakdown in equipment, cancellations or changes in flight, itineraries, schedules, and weather.

Force Majeure
We are not able to accept responsibility or pay any compensation in instances where the performance of our contractual obligations is prevented or affected by reason of circumstances amounting to “force majeure”. Circumstances amounting to “force majeure” include any event which we or the supplier of the service in question could not, even with all due care, foresee or avoid, such as war or threat of war, riot, civil strife, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, governmental action, industrial disputes, and all similar events beyond our control.

Health & Safety
Where tours involve walking, canoeing or riding, or bringing you into close contact with wild animals whose behaviour can be unpredictable, we take precautions to ensure that you are led by highly qualified and experienced guides but you must accept that, in purchasing these vacations, an element of personal risk is involved. At all times you must comply with reasonable instructions given by your guide. Activities such as ballooning, canoeing, white-water rafting and scuba diving may be available for you to book with local independent operators. All of these activities carry inherent risk. Each person wishing to participate may be asked to sign a form of waiver by the local operator which may limit or exclude its liability. These activities are not sold by us and do not form part of the vacation which we provide. Unless they are included in our itinerary and form part of the total price of your vacation. All participants must be over eighteen years of age and physically fit enough to take part. Safety equipments must be worn at all times and participants must comply with reasonable instructions given by the organiser of the activity.

Illness and Disability
If you or any member of your party suffers from a disability or other medical condition please inform us before you book. Opulent Africa Limited is happy to give you advice and to try to assist you in choosing a vacation that will meet your requirements. However, most of our itineraries are in destinations which are off the beaten track and lack even the simplest facilities for disabled guests such as ramps for wheelchairs, lift, etc. Many of our vacations require a fair degree of physical fitness. Medical facilities may not be readily available, particularly on safari. In order to assist you we must be provided prior to booking with full written details regarding your medical condition and any special requirements which result from this. An appropriate medical form will be sent to you for this purpose. Air travel can cause problems for some people with circulatory or bronchial problems, such as deep vein thrombosis. It is inadvisable for anyone with high blood pressure or respiratory problems to visit high altitudes. You should consult your doctor for advice before you book and in good time before your departure.

Data Protection
It may be necessary for us to ask you to provide certain information such as your name, address, dietary requirements or medical information. This information will be kept confidential and will not be shared with any other person who is not responsible for a part of your travel arrangements. In making a booking, you consent to this information being passed on to the relevant persons.
